Acceptable Use

This Acceptable Use Policy ("AUP") governs your use of MODTURA services and infrastructure, including modtura.com, websites we build and host on behalf of clients, our admin and content management tools, and any other product or service provided by MODTURA. It applies to clients, partners, and visitors. It is part of our Terms of Service.

If you violate this AUP, MODTURA may remove or disable the offending content, suspend or terminate your account, report you to the appropriate authorities, and pursue any other remedies available to us.

1. Lawful and Honest Use

You agree to use MODTURA services only for lawful purposes, in compliance with all applicable federal, state, local, and international laws. You agree not to misrepresent who you are, who you work for, or the nature of your business in any communication with MODTURA, with our partners, with our clients, or on a website we host.

2. Prohibited Content

You may not publish, host, or transmit content through MODTURA services that:

  • Is illegal, fraudulent, deceptive, or promotes unlawful activity.
  • Infringes any patent, trademark, copyright, trade secret, publicity, privacy, or other proprietary right of any third party.
  • Is defamatory, libelous, harassing, threatening, or constitutes hate speech, incitement, or discrimination on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, gender identity, age, disability, or any other protected characteristic.
  • Sexually exploits or endangers minors.
  • Contains pornographic or obscene material.
  • Promotes or facilitates the sale of regulated, restricted, or illegal goods or services in jurisdictions where the sale is unlawful.
  • Contains malware, viruses, ransomware, spyware, or any other harmful code.
  • Includes personal information of third parties without their consent.

3. Prohibited Conduct

You may not, and may not permit any third party to:

  • Use MODTURA services to send unsolicited bulk email, spam, or any communication that violates anti-spam or telemarketing laws (including CAN-SPAM, CASL, GDPR, and TCPA, where applicable).
  • Use MODTURA services to phish, deceive, impersonate, or steal credentials or financial information.
  • Attempt to gain unauthorized access to MODTURA systems, accounts, networks, or data, or to systems and accounts that belong to other clients, partners, or third parties.
  • Probe, scan, or test the vulnerability of MODTURA infrastructure without our written permission.
  • Interfere with or disrupt the integrity or performance of MODTURA services, including through denial-of-service attacks, traffic flooding, or excessive automated requests.
  • Reverse engineer, decompile, or attempt to extract the source code of MODTURA's proprietary software, frameworks, plugins, admin panel, or content management system, except to the extent allowed by law.
  • Resell, sublicense, or redistribute MODTURA services or any of MODTURA's proprietary tooling without our written consent.
  • Use MODTURA services to mine cryptocurrency, host high-volume file storage unrelated to the client's business, or otherwise consume resources in a manner inconsistent with normal small-business website operation.

4. Email and Outreach

If you send marketing email through systems integrated with your MODTURA website (for example, a connected CRM or email service), you must comply with all applicable laws governing commercial messages. This includes accurately identifying yourself, providing a clear unsubscribe mechanism, honoring opt-out requests promptly, and only contacting recipients who have given you a lawful basis to do so.

5. Partner Conduct

Partners are subject to additional conduct expectations under their Partner Agreement and Section B of our Terms of Service, including representing MODTURA accurately, not making unauthorized claims about our services, and complying with applicable laws governing referrals, advertising, and outreach.

6. Reporting Violations

If you become aware of content or conduct that violates this AUP — for example, abusive content on a website we host, an attempted security breach, or impersonation of MODTURA — please report it to hello@modtura.com with as much detail as possible. We investigate reports promptly and respond as appropriate.

7. Enforcement

MODTURA decides, at our sole discretion, whether content or conduct violates this AUP. We may take any action we consider appropriate, including removing content, disabling features, suspending or terminating accounts, preserving information for law enforcement, and pursuing legal remedies. Where reasonable and consistent with safety and legal obligations, we will provide notice and an opportunity to cure before suspending or terminating an account.

8. Changes

We may update this AUP from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of MODTURA services after the effective date constitutes acceptance of the updated AUP.
